Summary: “This report articulates an analytical perspective to four different topics under the civil law – marriage, divorce, polygamy and child custody which are considered in need of reform based on changes in family dynamics and the social spheres of the country. The report goes into further deep analysis of each topic with studies and experience from four other countries having the same basis for their laws. In other words, like Afghanistan, Bangladesh, Egypt, Malaysia and Pakistan are among those Islamic countries whose laws are based on Sharia Law and on the Hanafi school of thought. The aim of this report is to reflect the experiences of the other four countries in tackling reforms of civil laws as well as introducing different strategies helping to reform laws in the most advantageous way and ensuring protection for women and children. And how will it be used in Afghanistan? The report provides four separate sections, one on each topic with details of the presenters’ main points. Then, it introduces the major findings under each topic. In conclusion the report recommends some overall strategies to be implemented by different stakeholders in order to enhance and reform civil law in Afghanistan”—(p. e).
